Abstract

Ferrajoli confronts, in this already-classical work, the problems of both a scientific and a philosophical nature posed by the question: "Why punish?". Starting from a guarantee-oriented mentality, he carries out a consistent and diaphanous analysis on the ideology and philosophy that justify punishment, unveiling the points of view and the set of interests of the victim, of the delinquent, of the State and society as a whole. He also makes a series of concrete proposals to ensure both State excesses and victims' revenge are reduced to the minimum amount possible.
