Abstract

Spanish civil regulations consider the last will and testament to be the adequate instrument with which to organise properties and rights after death. This conception may have its nuances, as happens when the tester names a third party as a habilitated subject to designate successors and distribute the tester's properties. Territorial legislations -and even the Basque legislation- also admit this option, as against the criterion of the Spanish Civil Code.
